Creative Commons Licences for cultural heritage institutions, a Dutch perspective

Cultureel-erfgoedinstellingen die werken in hun verzamelingen en archieven voor het publiek toegankelijk willen maken, moeten hiervoor toestemming aan de rechthebbenden vragen, tenzij een auteursrechtelijke beperking van toepassing is. De wettelijke beperkingen van het auteursrecht bieden echter weinig ruimte voor dergelijke vormen van hergebruik, terwijl de rechthebbenden op 'oude' werken dikwijls zeer moeilijk te traceren zijn. Een complicatie vormt in dit verband het feit dat veel cultureel-erfgoedinstellingen zowel gedeeltelijk rechthebbende als (her)gebruiker zijn ten aanzien van de in de collecties opgenomen werken.
Gastonderzoekster Esther Hoorn heeft voor het IViR onderzoek gedaan naar de bruikbaarheid van Creative Commons licenties als middel voor bibliotheken, musea en (omroep)archieven om de werken uit hun verzameling publiek toegankelijk te kunnen maken met inachtneming van het wettelijk kader.
Cultural-heritage organisations that want to make their collections publicly accessible must ask the copyright holders for permission, unless a limitation on copyright is applicable. However, these limitations on copyright offer little room for such forms of re-use, while the copyright holders of 'old' works are extremely difficult to trace. A complication is that many cultural-heritage institutions are copyright holders as well as (re-)users of works in their collections. Research must be conducted into other possible legal obstacles impeding the use of Creative Commons-licences in this sector.

Guest researcher Esther Hoorn conducted research on how libraries, (broadcasting)archives, or museums can license their collections via Creative Commons within the legal limits.
